Legal experts and news reports have clarified the distinction between holding an Indian passport and possessing formal proof of citizenship under national law. While a passport serves as a primary travel document, it is not always considered definitive evidence of nationality in all legal contexts. This distinction has been highlighted by senior lawyers to address public confusion regarding how identification is categorized.

According to reports from News18 and Livemint, Section 20 of the Passports Act provides the central government with specific authority over these documents. Specifically, this section allows the state to issue passports or other travel documents to individuals who are not Indian citizens in cases deemed to be in the public interest. These provisions mean that the issuance of a passport does not automatically confer citizenship status upon the holder.

Senior advocate Ujjwal Nikam has clarified the legal position by distinguishing between identification documents and formal proof of nationality. He explained that while a passport is an identity document, it may not serve as a certificate of citizenship because of the government's power to grant travel permits to non-citizens under certain conditions. This distinction ensures that the state can manage travel permissions without these documents being used as primary evidence for citizenship status in legal proceedings.
